Pre-nuptial Agreements
Until recently Scotland had no culture of pre-nuptial agreements, but this is changing. People who have pre-established wealth now want to protect it in case their marriage or civil partnership breaks down.
As society becomes increasingly cosmopolitan, all types of boundaries are disappearing. Many couples now come together from from different countries of origin, social backgrounds and with different levels of wealth. They also bring a more sophisticated outlook to their relationship, one that allows a shared lifestyle whilst recognising their differences.
They recognise that pre-nuptial and pre-cohabitation agreements are a pragmatic way to reach agreement over issues that could create conflict in the future.
Although not fully tested by the courts, pre-nuptial agreements are believed to be enforceable in Scotland, and recent cases in England have suggested that they are an increasingly important factor in divorce and separation.
